Can an Orange or Osceola County judge appoint FC PsychExperts for a competency evaluation?
Not for a court-paid appointment. Administrative Order 2017-22-02 requires Ninth Circuit judges to pick competency experts from the circuit’s registry, and registry experts must keep a business office in Orange, Osceola, Lake, Brevard, Seminole or Polk County. Our offices are in Jupiter and Fort Lauderdale, so defense attorneys and prosecutors retain us privately instead.
Who pays for a competency evaluation in an Orlando criminal case?
The court pays the experts its judges appoint from the registry, up to 3 for an adult defendant. If the first expert finds the defendant competent and a party wants a second opinion, the party that asks pays for it. Experts hired by the State Attorney, the Public Defender, conflict counsel or private counsel are paid by whoever hired them.
Does the court pay for a sanity evaluation in Orange or Osceola County?
No. The Ninth Circuit says it doesn’t pay for sanity evaluations or competency restoration. The side raising or answering an insanity defense retains and pays its own expert. Florida presumes sanity, and the defense must prove insanity by clear and convincing evidence (Fla. Stat. 775.027).
Can a privately retained psychologist’s findings reach the judge at an Orlando competency hearing?
Yes. Florida Rule of Criminal Procedure 3.212(a) lets the court or either party call the appointed experts, and lets either party introduce additional evidence. A retained expert’s evaluation can be that evidence. Its weight depends on the method and the records behind it.
How fast does a competency case move in Orange and Osceola?
Rule 3.210(b) calls for a status hearing within 20 days of the motion and a final hearing within 45 days, absent good cause. Juvenile cases run under Fla. Stat. 985.19, and the Ninth Circuit appoints 2 or 3 registry experts for them. Give us the hearing date when you call.
